Welcome to Ash Robertson Design. These Terms of Service (“Terms”) govern your use of this website and any design, branding, or marketing services purchased through it. By using this site or engaging our services, you agree to these Terms. If you don’t agree, please don’t use the site or our services.
1. Who We Are
Ash Robertson Design (“we,” “us,” “our”) is a graphic and brand design studio based in Vancouver, BC, Canada, providing brand identity, marketing/social content, and print design services to small businesses, along with original artwork sold through our shop.
2. Services
We offer services that may include, but aren’t limited to:
- Brand identity design (logos, color palettes, brand guidelines)
- Marketing and social media content design
- Print and packaging design
- Custom illustration and artwork
Each project’s specific scope, deliverables, and timeline will be outlined in a separate quote, proposal, or agreement provided before work begins. These Terms apply in addition to anything agreed in that project-specific document; where the two conflict, the project agreement controls.
3. Shop Purchases
We also sell original hand-drawn artwork (stickers, prints, greeting cards, and similar items) through our shop. [Note: if items are sold via Etsy rather than directly on this site, that platform’s own terms and policies also apply to those purchases, in addition to these Terms.]
- All artwork is original and created by us unless otherwise stated.
- Product descriptions, sizing, and images are provided as accurately as possible, but slight variations (color, print finish) may occur.
- Returns & exchanges accepted within 30 days. Buyers are responsible for return postage costs. If the item is not returned in its original condition, the buyer is responsible for any loss in value.
4. Working With Us (Client Projects)
Quotes & Deposits. Custom design and branding projects begin with a quote. A deposit of 50% is required before work begins.
Revisions. Projects include 2 rounds of revisions as outlined in your project agreement. Additional revisions beyond that may be billed at my hourly rate.
Timelines. Project timelines depend on the scope of work and timely feedback/content from the client. Delays in receiving materials, approvals, or content from the client may extend the delivery date accordingly.
Client-Provided Content. If you provide photos, text, logos, or other materials for us to use in your project, you confirm that you own the rights to that content or have permission to use it, and that it doesn’t infringe on anyone else’s rights. You’re responsible for the accuracy and legality of any content you provide.
5. Payment
- Invoices are due upon receipt of the invoice date, unless otherwise agreed.
- We reserve the right to pause work on a project if payment is overdue.
- All fees are in CAD and don’t include applicable taxes unless stated otherwise.
- Except where required by law or otherwise stated in your project agreement, payments and deposits are non-refundable once work has begun.
6. Ownership & Intellectual Property
- Upon full payment, you receive ownership of the final approved deliverables for the agreed use outlined in your project agreement.
- We retain ownership of preliminary concepts, drafts, and any work not selected or fully paid for.
- We retain the right to display completed client work in our portfolio, website, and social media for promotional purposes, unless you request otherwise in writing (for example, if your project involves confidential or unreleased branding).
- Shop artwork (stickers, prints, cards, and similar items) remains our intellectual property. Purchasing a physical or digital product gives you the right to use it for personal use only — it doesn’t transfer copyright or grant permission to reproduce, resell, or use the artwork commercially, unless we’ve agreed to that separately in writing.
7. Acceptable Use
When using this site, you agree not to:
- Use it for any unlawful purpose
- Attempt to copy, resell, or misrepresent our original designs or artwork as your own
- Interfere with the site’s security or normal operation
8. Third-Party Links & Services
Our site may link to third-party sites (such as our Etsy shop, Instagram, or payment processors). We aren’t responsible for the content, policies, or practices of those third parties. Use of any third-party service is subject to that service’s own terms.
9. Disclaimer & Limitation of Liability
Our services and this website are provided “as is.” While we do our best to deliver quality work on time, we don’t guarantee that the site will be error-free or uninterrupted, and we’re not liable for indirect, incidental, or consequential damages arising from your use of the site or our services, to the fullest extent permitted by law. Our total liability for any claim related to a project is limited to the amount you paid us for that project.
10. Termination
Either party may terminate a project agreement as outlined in the project-specific proposal.
11. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of the site or our services after changes are posted means you accept the updated Terms.
12. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
